Terms & Conditions
1.1 These Terms and Conditions are the contract between you, any Invoice Addressee (if applicable) and Presbyterian Community Services relating to the Educarer Aide Training Programme (the Course) and for which you have chosen to apply.
1.2 These Terms and Conditions in addition to the following (where applicable):
- Letter of Undertaking
- Funding Criteria
will apply to the sale of the Course.
1.3 Please read the Terms & Conditions carefully before applying for the Course and paying the Fees. They tell you who we are, how we will provide your Course, how you and we can change or end the contract, what to do if there is a problem and other important information. If you have any questions or concerns, please contact us to discuss.
1.4 By applying for the Course, you are confirming your agreement to be bound by these Terms and Conditions for the duration of the Course and where any terms and conditions are expressed to continue beyond the term of this agreement, you agree to be bound by those terms and conditions after the end of the Course.
2.1 “PCS” means Presbyterian Community Services, whose registered office is at 89 Short Street, Golden Wall Centre, #08-08, Singapore 188216;
2.2 “Course” refers to the Educarer Aide Training Programme provided by PCS & supported by SG Enable;
2.3 “Course Fee” means the fee payable for the Course and shall include any GST payable (unless indicated otherwise) and shall exclude any additional charges;
2.4 “Course Materials” means any materials provided by PCS to you for the purposes of participating in the Course;
2.5 “day” means a working day not including weekends or public holidays unless the relevant clause says otherwise (e.g. by referring to calendar days);
2.6 “Funding” means the portion of course fee that is funded by external parties such as but not limited to SkillsFuture Singapore (“SSG”) and SG Enable (“SGE”);
2.7 “Invoice Addressee” means the company billing address indicated on registration form in relation to the payment of Course Fee and any additional charges (as applicable), where the person or entity responsible for paying these is not you;
2.8 “On-site Course” means any part of the Course that takes place face-to-face in an On-site Course (and the Course Materials to be provided by PCS if applicable);
2.10 “Refund Policy” means the refund policy (as amended from time to time) approved by PCS and available on the Website;
2.11 “Website” means http://pcs.org.sg/
3. Application Procedures
3.1 Application without complete information/certificates will not be processed.
3.2 Registration is on first come, first served basis upon receipt of completed registration form and payment of fees.
3.3 Applicants may be invited to attend interview screening and/or aptitude test as and when required by PCS.
3.4 All applications submitted are subjected to further approval and PCS reserves the right to reject any applications.
3.5 A legally binding agreement shall not come into existence until PCS has accepted your offer to enrol into the Course by sending you a separate confirmation e-mail of your acceptance onto the Course, which will be effective upon sending to you at the e-mail address you have provided.
3.6 PCS reserves the right to withdraw the Course at any time prior to the commencement of the Course.
3.7 PCS will base on the contact information provided from your application (i.e. phone number, email address, mailing address) for any correspondence and / or communication.
4. Course Fee, Payment & Funding
4.1 Prevailing GST rate applies to all course fee.
4.2 PCS accepts payment of course fee via one of the following channel:
- Cheque (made payable to “Presbyterian Community Services”)
4.3 The Fees for the Course may be displayed on the Website and/or the course brochure.
4.4 Any Fees paid will be refunded to you if PCS is not able to offer you a place on your chosen course or as otherwise set out in the Terms. Please refer to clause 5 for further information on refunds and compensation.
4.5 As the Course is an SSG funded course, you / Invoicing Addressee are permitted to pay upfront only a portion of the course fee (less the potential funding amount) at the point of application. In the event that you fails to meet any of the requirements set under the funding scheme and thereby resulting that your application for funding claim to be rejected by SSG due to any reasons, you are liable to pay the balance of the course fee (ie the potential funding amount) to PCS.
4.6 Should claims be unsuccessful for students utilising SkillsFuture Credit, the student will be required to make payment in full. PCS reserves the right to reject applicants if payment is not received.
4.7 In the event of any outstanding course fees payment, PCS reserves the right to withhold your Course Certificates until full payment has been received.
4.8 PCS reserves the right to transfer your Course Certificates to your sponsoring company in event of requests made by the company.
4.9 In the event when SSG rejects course fee claim submission upon completion of the Course, due to whatsoever reason, you / Invoicing Addressee will be liable to pay the “Funded Course Fee by SSG” to PCS within 14 calendar days from the date of rejection by SSG.
5. Withdrawal, Deferment & Cancellation
5.1 A written notice must be submitted and received by PCS before the course commences. The following refund policy applies:

PCS reserves the right to claim the full course fees of the consumed modules and any training allowance extended to student during course of study.
5.2 You may request a deferment of the Course where exceptional circumstances apply and you can support your request with evidence.
5.3 Where PCS exercises its discretion under Clause 5.2:
- An approved deferment period will be agreed subject to the availability and start dates of the indicated course.

5.4 You are not permitted to transfer your Enrolment on the Course to any other person under any circumstances.
6. Medical Examination
6.1 All students must undergo a pre-medical check-up and submit the medical report before course commencement.
6.2 All medical examination / pre-medical check-up expenses will have to be borne by the student.
6.3 In the event that the Course has commenced but the student did not pass the medical requirement, PCS reserves the right to terminate the student. The student will have to pay back the full course fees of the consumed modules.
6.4 PCS reserves the right to withdraw / reject an applicant with any medical history which could impede his / her performance as an ECCE practitioner.
7. On-Site Courses
7.1 Agreement To Voluntarily Assume Risk Of Death Or Personal Injury
You confirm that you are aware and acknowledge that attending the Course requires you to be in proper physical condition to participate actively in activities carried out in both outdoor and / or indoor conditions (subject to weather condition) at the premises of PCS and / or any other premises designated by PCS, and that there is a risk of death or personal injury to you while participating, observing, and / or assisting in the activities carried out during this course at the said premises.
You confirm that you assume full responsibility for your health, physical and / or medical condition when participating, observing, and / or assisting in the activities carried out during the Course at the premises designated by PCS.
You agree that PCS shall not be liable to your or your personal representative or estate whatsoever in the event of any death or personal injury to yourself sustained during your participation, observation and / or assistance in the activities carried out during this course at the premises of PCS and / or any other premises designated by PCS for the conduct of this course. You further confirm that in view of your voluntary assumption of the risk of death or personal injury to yourself, this waiver / exclusion of liability given to PCS applies even where death or personal injury to yourself has been caused by any negligence, breach of contract or any other breach of duty committed by PCS or its officers, servants, employee, agents or independent contractors.
You undertake to indemnify PCS against all liabilities losses costs and / or expenses suffered or incurred by PCS including legal costs and expenses in relation to, in connection with and / or arising from:
- Any of your act or omission during your participation, observation and / or assistance in the activities carried out during this course at the premises of PCS and / or any other premises designated by PCS for the conduct of this course.
- Any and all claims brought against PCS by third parties in relation to death or injury to persons or loss or damage, where and to the extent that such death injury loss and / or damage is attributable to any of your act or omission during your participation, observation and / or assistance in the activities carried out during this course at the premises of PCS and / or any other premises designated by PCS for the conduct of this course.
7.2 Your personal possessions are your sole responsibility. PCS accepts no responsibility and / or liability for anything that is lost or stolen from its venues. You are advised to avoid bringing any items of special value onto the PCS’s premises and to keep your possessions with you at all times.
7.3 Under no circumstances can a child or children be brought to the Course unless otherwise specified. PCS does not have crèche facilities and is not able to accommodate children at its premises or any venue or premises used for the purposes of delivering the Course.
7.4 PCS shall provide such facilitators and trainers to run the On-site Course as it, in its sole discretion and using reasonable care and skill, deems fit and PCS be entitled at any time to substitute any facilitator or trainer with any other person who PCS deems suitably qualified to facilitate the relevant On-site Course.
7.5 You acknowledge that PCS operates a zero-tolerance policy in relation to inappropriate behaviour of Course participants. In particular, abusive or violent behaviour directed at PCS’s staff or other Course participants and unfair or dishonest practices including but not limited to cheating, will not be tolerated under any circumstances. PCS may at its reasonable discretion and without liability or an obligation to refund Fees, refuse to supply any On-site Course to any participant and may refuse to admit, and may remove from any School premises or premises used for the purposes of delivering the Course, any individual whose participation in any On-site Course would, in PCS’s reasonable opinion, be undesirable or whose behaviour PCS considers is or may be in breach of the Terms.
8.1 By submitting your application to the Course, completing the registration form and paying the fees you agree that:
You meet the pre-requisites (if any) of the Course;
The information provided in your application to the Course is accurate to the best of your knowledge at the time of your application and that you will inform PCS should any circumstances change that do or might affect your eligibility to participate in the Course;
You will promptly inform PCS in the event that your personal or contact details change; and
You will be available to begin the Course at the stated date and for the duration of your Course.
8.2 As the Course is supported by SG Enable, you are required to attain at least 75% attendance per module*. There will be a 10-day “supervised practicum” component of the training. You are required to attain 100% attendance for the “supervised practicum”.
8.3 In the event the trainee is unable to meet the attendance requirements as spelt out in Clause 8.2 and / or complete all necessary assessments as required by SSG, SG Enable and PCS, leading to trainee being deemed as “Not Certifiable” for the Course, the following clause will apply:
- Trainees who fail to complete a module (or modules as the case may be) after the commencement of the Course, shall be liable to pay the full course fees.
- A failure to complete the module (or modules) shall include trainees who leave the Course, either through the withdrawal of their own accord or termination of candidature by PCS after the commencement of the Course, who fail to achieve at least 75% attendance and / or failed to be assessed for the modules (or each module if there are more than 1 module), or who have been assessed but failed to meet the requirements for each module (or modules).
9. Assessment & Certification
9.1 Trainees will undergo assessments in the form of individual and group projects, quizzes, oral questioning, role plays and practical performances.
9.2 Certificate of Attendance for each module will be issued to trainees who attained the required attendance as spelt out in Clause 8.2. Certificate of Achievement for each module will be issued to trainees who met the attendance requirement as well as passed all the assessments.
9.3 Trainees who have successfully attained Certificate of Achievement for all the required modules in the ECAT Course will be awarded an Educarer Aide Training Certificate in Early Childhood Care and Education.
10. Limitation of Liability
10.1 PCS provide goods and services in connection with the Course and any Course Materials for your personal use. If you use the Course or Course Materials for any commercial or business purposes, PCS will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
10.2 PCS will not be held responsible for any delay or failure to comply with its obligations under these Terms if the delay or failure arises from any causes which is beyond PCS’s reasonable control.
10.3 PCS will use its reasonable endeavours to deliver your Course in accordance with the description given on the Website and / or in the Course brochure at the date of its commencement. However, PCS reserves the right to make any variations to the Course which it reasonably considers to be necessary:
- To reflect changes to the theory in an area of research or practices around the subject or its delivery;
- As a result of a commissioning or accrediting body requiring certain content to be added to or changed within your Course; and/or
- If your educational experience would be or would be likely to be impaired if changes were not made to the Course.
The Course is for training purposes only. PCS will not accept any responsibility to any party for the use of the training provided and / or the contents of Course Materials for any purpose other than training for educational purposes including for any advice provided to a third party.
12. Intellectual Property
12.1 At all times, PCS remains the owner of the intellectual property in the Course and Course Materials. No Course and / or Course Materials, nor any part thereof may be reproduced, stored in a retrieval system or transmitted, communicated, broadcast or made available to any third party in any form or by any means without the prior written permission of PCS.
12.2 In consideration of receipt by PCS of the Fees, PCS grants to you a non-exclusive, non-transferable licence to use the Course Materials which PCS has provided to you for the sole purpose of studying for the relevant Course.
12.3 Save as expressly set out in these Terms, you may not modify, copy, reproduce, re-publish, sub-licence, sell, upload, broadcast, post, transmit, make available, communicate to the public, disseminate or distribute in any way any Course Materials.
12.4 Use of Course Materials not expressly permitted in these Terms is strictly prohibited and will constitute an infringement of either PCS’s copyright or other intellectual property rights.
12.5 If PCS removes you from the Course under Clause 7.5 of this agreement the licence to you to use Course Materials set out in Clause 12.2 shall automatically and immediately terminate.
12.6 You agree to grant to PCS in respect of any work produced by you during the Course, a worldwide, non-exclusive, perpetual, royalty-free licence to copy and display such work for promotional purposes only.
13. Data Protection
13.1 PCS is committed to maintain the confidentiality of the applicant’s personal information and undertakes not to reveal any of the applicant’s information to any 3rd party without prior written consent of the applicant.
14. Employment in the ECCE Sector Upon Completion of Training
14.1 Whilst employment upon completion of training is not guaranteed, in view of the Course fee funding, trainees are strongly encouraged to remain actively employed in any of the ECDA registered childcare centres and/or kindergartens for a minimum of 6 months after completion of the Course.
15.1 Course schedule and venue are subjected to confirmation. PCS reserves the rights to cancel/re-schedule the class and venue without prior notice.
15.2 Course status notification will be sent to you via email. If you do not hear from us five (5) days prior to commencement, please email to email@example.com.
15.3 PCS may update or amend these Terms and Conditions from time to time to comply with law or to meet its changing business requirements without notice to you. Any updates or amendments will be made via email.
15.4 This agreement shall be governed by and construed in accordance with the laws of Singapore including in respect of any non-contractual obligations. All claims, disputes or other matters in question between the parties related to or arising out of this agreement, including in relation to any non-contractual obligations, shall be subject to the exclusive jurisdiction of the Singapore Courts.
